 ABRSM urges NCTE to intervene in the Supreme Court’s decision related to Teacher Eligibility Test (TET)

A delegation of the Akhil Bharatiya Rashtriya Shaikshik Mahasangh (ABRSM) met Professor Pankaj Arora, Chairman of the National Council for Teacher Education (NCTE), in New Delhi.

The delegation requested the NCTE to intervene appropriately in the recent Supreme Court judgment dated 1st September 2025 (Civil Appeal No. 1385/2025) concerning the Teacher Eligibility Test (TET).

The Mahasangh expressed concern that the decision to make TET qualification mandatory for all serving teachers has created a serious situation affecting the continuity of service, promotions, and livelihood of nearly 2 million teachers across the country.

Prof. Geeta Bhatt, General Secretary of ABRSM, stated that as per the NCTE Notification dated 23 August 2010, it is clearly mentioned that under Section 2(n) of the Right of Children to Free and Compulsory Education (RTE) Act, 2009, the minimum qualifications for appointment as a teacher for Classes I to VIII shall be effective from the date of the said notification. Therefore, ABRSM urged that the Supreme Court decision should be applied prospectively and not retrospectively.

The Mahasangh further pointed out that since the RTE Act was implemented in different years across various States, the cut-off date should accordingly be determined state-wise, keeping in view the local context. It was also requested that the services, seniority, and dignity of experienced teachers appointed with valid qualifications be protected, and that necessary legal measures be taken to prevent any adverse impact on their service or promotion.

Prof. Bhatt reiterated that ABRSM is fully committed to maintaining the quality and standards of education, but at the same time believes that protecting the rights and dignity of teachers who have devoted their lives to this noble profession is equally essential.

 शिक्षक पात्रता परीक्षा (TET) संबंधी सर्वोच्च न्यायालय के निर्णय पर NCTE से हस्तक्षेप का आग्रह

अखिल भारतीय राष्ट्रीय शैक्षिक महासंघ का एक प्रतिनिधिमंडल आज राष्ट्रीय अध्यापक शिक्षा परिषद (NCTE) के अध्यक्ष प्रो. पंकज अरोड़ा से नई दिल्ली में मिला। प्रतिनिधिमंडल ने शिक्षक पात्रता परीक्षा (TET) से संबंधित सर्वोच्च न्यायालय के हालिया निर्णय (दिनांक 01 सितम्बर 2025, सिविल अपील संख्या 1385/2025) में NCTE द्वारा उचित हस्तक्षेप किए जाने का अनुरोध किया।

महासंघ ने अवगत कराया कि सभी कार्यरत शिक्षकों के लिए TET उत्तीर्ण करना अनिवार्य करने संबंधी इस निर्णय से देशभर के लगभग 20 लाख शिक्षकों की सेवा निरंतरता, पदोन्नति एवं आजीविका पर संकट उत्पन्न हो गया है।

महासंघ की महामंत्री प्रो. गीता भट्ट ने बताया कि NCTE की अधिसूचना दिनांक 23 अगस्त 2010 में स्पष्ट रूप से उल्लेख है कि “बच्चों को नि:शुल्क और अनिवार्य शिक्षा का अधिकार अधिनियम (RTE), 2009” की धारा 2(एन) के अंतर्गत कक्षा 1 से 8 तक शिक्षक के रूप में नियुक्ति हेतु आवश्यक न्यूनतम योग्यता अधिसूचना की तिथि से प्रभावी होगी। अतः महासंघ ने यह आग्रह किया कि सर्वोच्च न्यायालय का यह निर्णय भविष्य के लिए लागू किया जाए, न कि पूर्वव्यापी रूप से ।

महासंघ ने यह भी कहा कि RTE अधिनियम विभिन्न राज्यों में अलग-अलग वर्षों में लागू हुआ है, इसलिए राज्यवार कट-ऑफ वर्ष निर्धारित किया जाना ही न्यायसंगत रहेगा। साथ ही, वैध योग्यता पर नियुक्त अनुभवी शिक्षकों की सेवा, वरिष्ठता एवं गरिमा की रक्षा सुनिश्चित की जाए तथा सेवा समाप्ति और पदोन्नति पर प्रतिकूल प्रभाव रोकने हेतु आवश्यक कानूनी कदम उठाए जाएँ।

प्रो. भट्ट ने कहा कि महासंघ शिक्षा की गुणवत्ता और मानकों के संरक्षण के प्रति पूर्णतः प्रतिबद्ध है, परंतु साथ ही उन शिक्षकों के अधिकारों और आत्मसम्मान की रक्षा को भी समान रूप से आवश्यक मानता है, जिन्होंने अपना जीवन इस महान सेवा को समर्पित किया है।
